All home improvement contractors in New York City need to be licensed to perform the following services, among others:

construction, repair, remodeling, or addition to any land or building used as a residence. This includes, but is not limited to, the construction, replacement, or improvement of basements, driveways, fences, garages, landscaping, patios, porches, sidewalks, swimming pools, terraces, and other improvements to structures or upon land that is next to a home or apartment building.?

In New York City, there is also a license requirement called a Home Improvement Salesperson License for those who "solicit, negotiate, or offer to negotiate a home improvement contract with a property owner".

Obama tackles rape comments, "fiscal cliff" on TV talk show

BURBANK, California (Reuters) - President Barack Obama suspended the levity during an interview with late-night TV talk show host Jay Leno on Wednesday to address a Republican Senate candidate's assertion that pregnancies resulting from rape are intended by God and to express confidence that Washington could soon address the looming "fiscal cliff."

"I don't know how these guys come up with these ideas. Let me make a very simple proposition: rape is rape. It is a crime," Obama said on NBC's "The Tonight Show."

"This is exactly why you don't want a bunch of politicians, mostly male, making decisions about women's healthcare."

Indiana Republican Senate candidate Richard Mourdock's comments that pregnancies caused by rape are "something God intended to happen" echoed across the U.S. media and sent ripples through political circles ahead of the November 6 election.

The Obama campaign, which enjoys leads among women voters in many election battleground states, sought swiftly to connect Mourdock with Republican presidential candidate Mitt Romney. This summer Romney had to distance himself from remarks by another Republican Senate candidate, Todd Akin of Missouri, about what he called "legitimate rape."

In an interview full of jokes about marriage, Halloween and other topics, the Democratic president made a few serious comments, mostly about the hottest topic of the election: the economy.

Asked about the so-called fiscal cliff - a combination of automatic spending cuts and tax hikes set to kick in early next year - Obama said he was confident that a solution could be found before the end of the year.

"Solving this is not that hard. It requires some tough choices," Obama said, adding that some programs had to be cut and tax rates should go up for people making more than $250,000 a year.

"I hope that we can get it done by the end of this year. It just requires some compromise, which shouldn't be a dirty word."

On the economic crisis gripping the European Union, Obama said countries have been "kind of muddling along" and "they didn't respond as quickly as they could."

The United States is working with those nations to make sure they have a credible plan to maintain the unity of Europe, he added.

In a lighter moment, Obama joked about real estate mogul and TV personality Donald Trump, who recently posted a video challenging Obama to release documents about his education.

Trump has persistently questioned whether Obama, a native of Hawaii, was actually born in the United States, and Obama played off Trump's theories about his origins.

"This all dates back to when we were growing up together in Kenya," Obama joked. "We had, you know, constant run-ins on the soccer field. He wasn't very good and resented it."

The Very Coherent Case for Coherent Networking

A constant ? as certain as the fact that there are lots of political ads running in Ohio and Virginia ? is that more bandwidth is needed. That?s true in wireless networks that connect to devices and it is true in the core of the network.

The most common approach to optical core networking is to have lasers flash on and off rapidly ? very rapidly ? to represent ones and zeros. Doing this on many wavelengths simultaneously has enabled the telecommunications infrastructure to keep pace with radically accelerating demands.

This approach may be reaching its limits, however. Another technique is coherent optical networking, which could be the most efficient way of transmitting at 100 Gigabits per second (Gbps), which is the state of the art (or, more accurately, the state of the speed).

The basic idea is explained in this Ciena video (the explanation starts at about the 45-second mark, though no explanation is given for the out-of-place music). Essentially, instead of turning the laser on and off, coherent enables data to be embedded at different amplitudes and phases (areas of the signal).

Lightreading looks at the technology in the context of undersea cables. The ability to radically increase capacity is especially important in this realm, since it can spell the difference between changing electronics at the end points or laying an entirely new cable.

The story quotes Mike Guess, a vice president at Infinera:

The introduction of coherent capabilities has enabled the industry to upgrade from 10-Gbit/s wavelengths, which had been the standard for more than a decade, straight to 100 Gbit/s. Infinera's Guess says the subsea industry has been wanting to upgrade capacity for a long time, "but the problem was making [new systems] reach as far as 10G." Coherent, he says, "has the performance base to make 100G practical."

The story says that coherent also is important for landlubbing networks.

There are announcements on the coherent networking front. Half a world away, for instance, Huawei announced that the Gansu Administration of Radio, Film and Television will deploy China?s first network combining 100 Gbps coherent technology with the vendor?s optical transport network (OTN) platform. The network will support video-on-demand, high-definition video, broadband and other services.

Earlier this month, Ciena announced that, partnering with LightRiver Technologies, it will deploy packet networking and packet-optical transport equipment for Sovernet Fiber Corp. The press release has the details on the deal, which will include Ciena?s coherent technology. Sovernet, a subsidiary of Atlantic Tele-Network, provides telecom service in northern New England.

As Ciena Senior Vice President of Marketing Rick Dodd says in the YouTube video, coherent technology allows the lasers to be tuned like a radio, instead of being turned on and off like a flashlight. That is an effective analogy, and one that suggests that there is a very coherent argument for coherent technology.

NHL lockout putting sales for small businesses that depend on pro ...

NEW YORK, N.Y. - In cities with professional hockey teams, it seems that the only thing on ice these days is sales ? at least at the bars, restaurants and other small businesses that cater to sports fans.

Bars and restaurants normally filled to capacity in St. Paul, Minn. on nights when there's a Minnesota Wild game have empty tables. An impasse between the National Hockey League and the NHL Players' Association has resulted in games being cancelled at the nearby Xcel Energy Center. That means fewer people are coming into town.

Business at the Great Waters Brewing Co., a brewpub located near the Xcel Center, is down 20 per cent since the start of the lockout. For owner Sean O'Byrne, it's a painful reminder of the 2004-05 lockout that wiped out the entire NHL season. But he says the current dispute, which so far has resulted in games being cancelled through Nov. 1, is harder because small businesses like his are still recovering from the recession.

"The economic times are different now, and I think the one thing that's become apparent to me is the sort of ripple effect the hockey strike has," he says. "It's not just the bars and restaurants, it's the local food vendors and their suppliers."

Strikes and lockouts in major sports leagues ? whether it's this year's NHL lockout, last year's National Basketball Association lockout or baseball and football strikes of the past ? can have a devastating effect on small businesses that cater to sports fans. When 18,000 fans don't stream into a downtown arena on a game night, restaurants and bars have far fewer people to serve and parking lots can sit empty. There are fewer shoppers in downtown stores. It's particularly painful in a town like St. Paul or Pittsburgh, where there's no NBA team to help make up for the losses. And it's tough for a business still being hurt by a weak economy.

A PRECARIOUS POSITION

So far, the NHL has cancelled 135 games through Nov. 1. Each team plays 42 home games. The impact of the lockout stretches across 30 teams in U.S. cities including Nashville, Tenn., Los Angeles, and Raleigh, N.C. Twenty-three of the teams are in the U.S. and the rest are based in Canada.

In Pittsburgh, each cancelled game at the Consol Energy Center is estimated to cost the city $2.2 million, says Craig Davis, president of VisitPittsburgh, the city's tourism office. That amount includes tickets and food sales at the arena, spending at restaurants and bars, hotel rooms and parking. Not all of that money is lost by small businesses ? many hotels, for example, are owned by big corporations. And downtown Pittsburgh hosts conventions during the fall, which helps mitigate some of the financial damage.

Still, for small companies that benefit from having a hockey team nearby, the timing couldn't be worse.

"Businesses are coming out of the worst six years in the economy and so they're already in a precarious position," says St. Paul Mayor Chris Coleman. "They're completely dependent on 42 days of hockey to make their year."

St. Paul and nearby Minneapolis are big hockey towns. The previous NHL team, the North Stars, played in nearby Bloomington until they moved to Dallas in 1993. The Wild began playing in 2000. And the University of Minnesota team has many local fans. St. Paul businesses had particularly high hopes for this season because the Wild recently acquired two big stars, forward Zach Parise and defenceman Ryan Suter, Coleman says.

"It's a double whammy, the anticipation was so great that coming out of a recession, this was going to be a really good year for us," he says.

Some business owners changed their approach after the 2004-05 lockout, says Matt Kramer, president of the St. Paul Chamber of Commerce. One strategy many owners have adopted is to increase their marketing efforts to nearby businesses to expand their customer base, he says.

"A lot of people who saw that lockout as unbelievable and painful said, 'we'll never put ourselves in a position again where we're dependent on a single business,'" Kramer says. "People have tried to be a little more careful about saying, 'we're a hockey bar.'"

An owner who can't escape his connection to hockey is Tom Reid, a former North Stars defenceman who owns Tom Reid's Hockey City Pub, located two blocks from the Xcel Center. Reid says his business is down 70 per cent on nights when hockey games were scheduled.

The lockout means Reid has no need for his usual contingent of 30 to 35 servers. Right now he has six.

"We've trained some people, but we can't bring them in until we have the business to support it," he says.

SOME LOSSES, SOME GAINS

It's true that many small businesses will suffer because of the lockout, but other local businesses stand to gain from it, says Allen Sanderson, a lecturer at the University of Chicago whose specialties include the economics of sports. If there are no hockey games, fans will find some other form of entertainment.

"If my wife and I decide to go to a (Chicago) Black Hawks game and we can't, we'll go to a mall or a movie or the symphony. We'll just spend the money somewhere else," he says.

But for Kevin Joyce, who owns The Carlton, an upscale restaurant near Pittsburgh's Consol Center, the lack of Penguins games hurts his business.

"This is really devastating. It's very disheartening to have gone through this eight years ago and go through it again," Joyce says. The last few months of the year and the first quarter are the busiest season for his restaurant, but business is so slow that on some nights, he has only four servers. On hockey nights, he might have as many as 12.

Joyce says the fine dining business was difficult even before the 2004-05 lockout, which he estimates cost him $150,000 in revenue. He says the 2001-02 recession, the Sept. 11, 2001, terror attacks and this last recession have posed a series of challenges for The Carlton. Joyce says the restaurant is subsidized by a takeout business he and his wife own, Eadie's Kitchen & Market.

"It's a very difficult environment. ... I haven't been able to give raises to my salaried employees for several years," Joyce says. He used to have three managers working with him. Now he has one.

Retailers who sell hockey-themed clothing and gifts are also experiencing a sales dip. Sales of Penguin merchandise is down between 20 per cent and 30 per cent at The Pittsburgh Fan, according to Eric Castellucci, the company's online marketing manager. The Pittsburgh Fan also has a store in town, near PNC Park, where baseball's Pirates play.

The Pittsburgh Fan has cut prices on Penguin gear by 35 per cent to get fans interested in buying. "It would have been a lot better had the Penguins been playing," Castellucci says.

Businesses in cities where there are multiple sports teams are having an easier time ? for now.

At the Fireside Bar & Grille, a sports bar in the Philadelphia suburb of Ambler, owner Pete Penna says business isn't being hurt by the absence of Flyers games. The baseball playoffs are still drawing people even though the Phillies' season is over. Philadelphia is also a big football town, with the Eagles and college teams from Temple and Villanova. And the Philadelphia 76ers are playing again now that pro basketball is back. Penna's 17 TV screens have plenty of sports to keep customers coming in.

Still, the NHL lockout will become a problem if it stretches out into the winter.

"The Flyers account for a good 20 to 30 per cent of our bar business in January, February and March. If there's no hockey by then, it will have an impact," Penna says.

Michael Arrington is writing for TechCrunch again.

A year ago, he was booted from AOL because then media boss Arianna Huffington didn't like how he was an investor in startups, writing about startups.

But now Huffington is no longer the boss of all AOL media. She's over in the Huffington Post corner (a very big corner).

The current boss of AOL's tech media brands doesn't care as much.

MG Siegler, Arrington's partner at a VC firm called Uncrunched, is also going to be writing more for TechCrunch again (though he never actually stopped).

Arrington's explanation:

(AP) ? Facebook finally has proof that it can make money from mobile advertising.

As part of Tuesday's third-quarter results, the world's biggest social media company disclosed for the first time that some 14 percent of its ad revenue came from mobile advertising. It started showing ads to users who access Facebook from their phones and tablet computers about six months ago.

Since before the company's initial public offering in May, investors have worried that Facebook isn't taking advantage of its growing mobile user base.

"I want to dispel this myth that Facebook can't make money on mobile," said CEO Mark Zuckerberg in a conference call with analysts. "This may have seemed true earlier this year because we hadn't started trying yet."

Tuesday's quarterly financial report ?Facebook's second as a public company? sent its stock up $2.53, or 13 percent, to $22.03 in after-hours trading. Facebook had closed up 18 cents at $19.50 in regular trading on a day that saw the Dow Jones Industrial Average drop 243 points, or 1.8 percent.

Facebook Inc. posted a loss of $59 million, or 2 cents per share, in the July-September period. That's down from earnings of $227 million, or 10 cents per share a year ago, when Facebook was still privately held.

Excluding special items, mainly related stock compensation expenses, Facebook Inc. earned $311 million, or 12 cents per share, in the latest quarter, a penny better than what analysts were expecting.

Revenue rose 32 percent to $1.26 billion from $954 million. That's also higher than the $1.23 billion that analysts polled by FactSet had expected.

Facebook's monthly user base grew 26 percent from a year earlier, to 1.01 billion. Some 60 percent of users access Facebook using a mobile device, the company said. At the end of the second quarter, less than 57 percent of its then-955 million users came from mobile devices.

"People who use our mobile products are more engaged, and we believe we can increase engagement even further as we continue to introduce new products and improve our platform," Zuckerberg said. "At the same time, we are deeply integrating monetization into our product teams in order to build a stronger, more valuable company."

Advertising revenue was $1.09 billion, up 36 percent from a year earlier. It represented about 86 percent of Facebook's total revenue. In the second quarter, Facebook's ad revenue grew at a slower pace ? 28 percent from a year earlier, to $992 million. Baird analyst Colin Sebastian said that besides the mobile progress, the acceleration of ad revenue was a big reason for Facebook's stock price jump.

"There was some debate that they'd be able to pull that off," he said.

Revenue from payments and other fees climbed 13 percent to $176 million. The figure includes Facebook's cut from the virtual items people buy for games they pay on the site. Facebook said that while payments from Zynga Inc. declined, its overall games ecosystem has become more diverse. In recent quarters Facebook has derived as much as 12 percent of its revenue from "FarmVille" maker Zynga Inc., but Zynga has been experiencing a slowdown. Zynga said Tuesday that it is laying off about 5 percent of its workforce of 3,000 people.

Facebook did not provide guidance for the current quarter or beyond, a practice it has maintained since its first earnings report as a public company in late July.

Facebook's stock has been trading at roughly half of its initial public offering price of $38. The May 18 IPO was one of the most highly anticipated offerings in recent years, but the excitement quickly deflated ? in part due to concerns about Facebook's ability to grow mobile ad revenue. The stock has not traded above its IPO price since its first trading day.

Though investors took it as a good sign, Sebastian called Facebook's mobile progress incremental.

"They have a lot of work to do," he said.

Facebook's challenges include ensuring that users are not overwhelmed by mobile ads bombarding their smaller phone and tablet screens. Chief Operating officer Sheryl Sandberg said the company monitors user engagement to make sure this doesn't happen.

As Facebook's user growth inevitably plateaus, the company will also have to grow the money it makes from each user, Sebastian said, adding that Facebook is on the right path as it experiments with new ad formats and products.

Nokia seeks $1 billion from bonds to help drive fightback

HELSINKI (Reuters) - Mobile phone maker Nokia plans to raise 750 million euros ($980 million) by issuing bonds that can be converted into shares, seeking a cheap way to bolster its fragile finances as it battles to claw back market share lost to Apple and Samsung.

Once the world's biggest mobile phone maker, the Finnish firm has fallen far behind Apple's iPhone and Samsung's Galaxy phones in the lucrative smartphone market, and is pinning its hopes for recovery on new models that go on sale next month.

With its cash reserves falling and its credit ratings cut to junk over the past year, analysts have said Nokia needs to show a turnaround in the next several months if it is to survive.

Its shares fell over 7 percent to around 2 euros in Tuesday afternoon trade as investors worried the eventual conversion of the new bonds into stock would reduce earnings per share.

But analysts said the choice of convertible bonds - which normally pay lower interest rates than normal bonds because they offer investors the chance of making money when they are converted into shares - was a smart one.

"It is a rather cheap way to get extra financing," said Evli analyst Mikko Ervasti. "They need buffers (and) their 2014 bond also requires financing."

Nokia's net cash fell to 3.6 billion euros in September from 4.2 billion in June. It also finished the third quarter with 3.8 billion euros in interest-bearing liabilities, with 1.75 billion in bonds and loans maturing in 2014.

Additionally, the company owns half of network equipment venture Nokia Siemens Networks, which finished the quarter with 1.4 billion euros in liabilities.

The convertible bonds will be due in 2017 and will pay a coupon between 4.25 percent and 5.00 percent. The initial price for conversion into ordinary shares is expected to be 28-33 percent above the average price of Nokia shares between the launch and pricing of the offering.

PINNING HOPES ON LUMIA

Nokia's fortunes hinge on its top-of-the-range Lumia 820 and 920 models, which run on Microsoft's new Windows Phone 8 software. The phones, which come in vivid colors and have high-resolution cameras, will hit the stores in November.

On Tuesday, the group unveiled the lower price Lumia 510, which is an update of the Lumia 610 but does not use the newest version of Windows software. The 510 has a larger screen and will be sold for around $199, excluding taxes and subsidies.

ING analysts welcomed the convertible bonds plan as reducing uncertainty around Nokia's short-term debt maturities and bolstering its capital.

"It also shows that the company is taking the question marks around its credit quality seriously and is willing to take the steps necessary to improve this," they said in a research note.

Nokia's five-year credit default swaps were trading around 2.8 percent tighter in earlier trading, meaning lower costs of insuring the company against default.

The final terms of the convertible bonds, including the conversion price and maximum number of shares which may be issued upon conversion, will be announced later in the day. Trading in the bonds are due to start around October 26.

BofA Merrill Lynch, Barclays, Citi and Deutsche are the joint bookrunners.

Boeing leads Dow average higher in early trading

NEW YORK (AP) ? Stocks are opening higher on Wall Street, following a big drop the day before, after big companies including Boeing reported stronger profits.

Boeing was the biggest gainer in the Dow Jones industrial average, rising nearly 2 percent, after saying its full-year profits will be better than expected thanks to a pickup in commercial airplane deliveries.

Shortly after the opening bell Wednesday the Dow was up 36 points at 13,138.

The Standard & Poor's 500 was up six points at 1,419 and the Nasdaq rose 21 points to 3,012.

Facebook jumped $4.26 to $23.76 after its quarterly report late Tuesday reassured investors that the social media site was taking in significant revenues from mobile advertising.

Netflix plunged $8.22 to $60 after cutting its forecast for full-year additions of video streaming subscribers.

Prison looks likely for France's rogue trader Kerviel

PARIS (Reuters) - Jerome Kerviel, the man behind France's biggest rogue-trading scandal, finds out this week whether he is heading to prison or walking free after his last court appeal in a four-year battle against former employer Societe Generale .

Former trader Kerviel submitted a final attempt in June to be acquitted and avoid a three-year jail sentence handed down in 2010 for his role in taking huge, risky bets that cost SocGen 4.9 billion euros ($6.4 billion) to unwind and slammed the French bank's reputation.

Wednesday's verdict, barring unexpected legal challenges, will be the final say on a case during which Kerviel, who has kept an impassive front throughout, built a cult following.

While Kerviel has never denied masking the 50 billion euro positions that made headlines around the world as the financial crisis unfolded in early 2008, he has always said his bosses knew what he was doing - which SocGen denies.

The outcome will be closely watched by a financial industry facing other lawsuits over crisis-era behavior. A similar trial is unfolding in London over the role of trader Kweku Adoboli in a $2.3 billion loss at UBS .

"These appear to be spectacular cases by virtue of the size of the risks taken by these traders and the danger that they put their banks in," said Emmanuel Moyne, a litigation lawyer at Linklaters in Paris.

"But if you compare it to cases where the amounts involved were much smaller, it is no different to people who simply cheated an internal controls system."

NO "SMOKING GUN"

SocGen, which refutes any responsibility for the trades, hopes it will once again be cleared in a saga that has dogged employees and Chief Executive Frederic Oudea since he took over from Daniel Bouton in 2009.

A ruling of responsibility or liability on SocGen's part would probably mean the bank having to repay 1.7 billion euros in tax write-offs relating to the losses. It would also likely get Kerviel off the hook regarding the full, court-ordered repayment of the 4.9 billion euros lost.

Former CEO Bouton testified both this year and in 2010, calling Kerviel a "great deceiver" and saying that the bank's risk managers and back-office staff never stood a chance against the trader's manipulations.

Meanwhile, Kerviel and lawyer David Koubbi have stuck to Kerviel's strategy - which lost him the case in 2010 - of insisting that all blame should be lain at SocGen's door.

With the appeal having uncovered no "smoking gun" against SocGen, it is unlikely that the 35-year-old former trader will win acquittal, lawyers say. The prosecution has called for Kerviel to serve five years in jail.

"The appeals process did not really change the presentation of the facts...I don't see the judge completely overturning the first conviction," said Hubert de Vauplane, a partner at Kramer Levin.

DETERRENT EFFECT

If Kerviel is put behind bars, the verdict will send a strong signal to the financial community - albeit four years after the bets themselves were uncovered.

Rather than prompting banks to tighten their risk controls systems, Kerviel's jail time is more likely act simply as a deterrent to employees and management in the financial sector.

"The heavier the sentences, the more likely it is that traders will take them into account," said de Vauplane. "A final prison sentence would set an example."

Asia stocks muted as US earnings underwhelm

BANGKOK (AP) ? Asian stock markets stalled Tuesday following the release of disappointing U.S. corporate earnings, but a weakening yen helped support Japanese shares.

Japan's Nikkei 225 index rose 0.1 percent to 9,017.83, a day after the country's currency fell to a three-month low against the dollar. A weak yen helps the country's mammoth export sector by raising the value of company profits repatriated from abroad.

South Korea's Kospi shed 0.3 percent to 1,934.59. Australia's S&P/ASX 200 added 0.2 percent to 4,550.40. Benchmarks in Singapore and Indonesia rose while Taiwan's fell. Mainland Chinese shares were mixed and Hong Kong markets were closed for a public holiday.

U.S. stock markets were nearly flat Monday after investors were hit with more underwhelming third-quarter earnings reports. Investors were disappointed by earnings reports from toy maker Hasbro, clothing maker VF Corp., regional bank SunTrust and other companies.

The Dow Jones industrial average rose marginally to 13,345.89. The Standard & Poor's 500 index rose less than 0.1 percent to 1,433.81. The Nasdaq composite index rose 0.4 percent to 3,016.96.

In currencies, the euro rose to $1.3053 from $1.3045 late Monday in New York. The dollar slipped slightly to 79.84 yen from 79.89 yen.

The Japanese currency fell to its lowest level against the dollar in over three months Monday after Japan said that its exports fell 10.3 percent in September from a year earlier.

Benchmark oil for November delivery was up 41 cents to $89.06 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell $1.32 to finish at $88.73 in New York.

Argentina in diplomatic offensive at U.N. over seized ship

UNITED NATIONS/ACCRA (Reuters) - Argentina's foreign minister launched a diplomatic offensive in New York on Monday, urging top U.N. officials to pressure Ghana to release an Argentine naval training vessel seized after creditors won a court order to keep the ship in port.

Foreign Minister Hector Timerman's appearance at U.N. headquarters came as sailors from the detained ship prepared to leave Ghana after spending weeks in dockside limbo, a government official said in Accra.

The ARA Libertad, a tall sailing ship with a crew of more than 300, has been detained in Ghana's port of Tema since October 2 on a court order obtained by NML Capital Ltd, which claims Argentina owes it $300 million from defaulted bonds.

Timerman has been in New York since last week, when Argentina was elected for a two-year term on the 15-nation U.N. Security Council that begins on January 1, 2013.

He met on Monday with U.N. Secretary-General Ban Ki-moon, General Assembly president Vuk Jeremic and the president of the Security Council, Guatemalan Ambassador Gert Rosenthal. Jeremic's office issued a statement after he met Timerman.

Timerman "expressed his grave concern about the situation and reiterated his call to the government of Ghana to desist from its conduct and respect its obligations under the United Nations Convention on the Law of the Sea," and other international laws, Jeremic's office said.

"The president (Jeremic) underlined the need for all member states to fully comply with their obligations under international law and conveyed his disposition to assist both parties to reach a solution on the issue," the statement added.

Ban's office also issued a statement, saying the U.N. chief "expressed the hope that both governments will find a way to address the matter on a bilateral basis."

Speaking to reporters at the world body, Timerman said he used his U.N. meetings to make clear Argentina's opposition to Ghana's moves.

"We've said that, although we were going to exhaust all legal avenues within Ghana, we reserve the right to go to international courts because this is a violation of a convention signed by both Argentina and Ghana," Timerman said.

Timerman expressed little sympathy for NML Capital or investment funds in general.

"We're not going to negotiate with vulture funds," he said. "We're going to keep on fighting and demand in the G20 the total and absolute elimination of the possibility for these vulture funds that work from tax havens to try to stamp on the sovereignty of countries like Argentina."

NO MORE SWABBING DECKS

Meanwhile, the ship's crew stranded in Ghana was getting ready to leave the country.

"We are preparing them and most of them will start leaving tomorrow, if they are able to complete their immigration processes," a government source told Reuters on condition of anonymity.

He said most of the remainder of the crew would leave in batches throughout the week.

Argentine President Cristina Fernandez on Saturday ordered 326 sailors on the detained ship to evacuate - leaving just the captain and a core crew - claiming their human rights were violated because a judge had prohibited fuel deliveries required to run plumbing and emergency equipment.

Ghana said on Sunday the crew was free to depart and NML's lead lawyer, Ace Ankomah, said it would not stop them from leaving.

The sailors appeared to be in good spirits on Monday as they worked the decks. Some returned from the city with suitcases and packing boxes, a Reuters witness at the port said.

Since the ship's detention three weeks ago, the crew has often been seen jogging, playing soccer and shopping at local markets.

"Ghana is a nice country, the people are nice, but still, being here doing nothing is different from being home doing nothing," one of them, a man in his mid-20s, told Reuters during a visit to the port's duty-free shop.

Argentina declared a massive sovereign default a decade ago at the height of an economic crisis and now faces a raft of lawsuits in U.S. courts by so-called holdout bondholders seeking Argentine assets to recoup the defaulted bonds.

Ghana said it turned down demands by Argentina to release the boat because it wanted to comply with the law.

    Zito, Giants beat Cards, close NLCS deficit to 3-2

    ST. LOUIS (AP) ? The San Francisco Giants waited quite a while for this kind of performance from Barry Zito.

    The soft-tossing lefty was at his best Friday night, pitching San Francisco back into the NL championship series with a 5-0 win over the St. Louis Cardinals that narrowed its deficit to 3-2.

    "This is definitely it for me," Zito said. "Coming here, especially doing it in a Giants uniform. A lot of people were saying stuff about A's days. And for me, the most important thing is doing everything for San Francisco right now."

    The Giants' win in Game 5 sent the series to San Francisco. Game 6 will begin Sunday in the twilight at AT&T Park, with Ryan Vogelsong pitching against the Cardinals' Chris Carpenter.

    Zito looked like the same guy who won the 2002 AL Cy Young award with the Athletics. He retired 11 batters in a row in one stretch while scattering six hits with six strikeouts in 7 2-3 innings.

    Giants catcher Buster Posey twice tapped Zito on the chest when he was pulled in the eighth. It was Zito's first postseason win since 2006, shortly before he left the A's and signed a $126 million, seven-year contract with San Francisco.

    Zito was left off the postseason roster when the Giants won the 2010 World Series because he had pitched so ineffectively. He started Game 4 of the division series against the Reds earlier in this year's playoffs and lasted only 2 2-3 innings.

    "I couldn't be happier for him," manager Bruce Bochy said. "He had it all going. HE put on quite a show."

    The defending champion Cardinals might have thrown away a chance to clinch a second straight World Series trip. Pitcher Lance Lynn's toss on a possible forceout deflected off the second-base bag, paving the way for the Giants' four-run fourth.

    "I don't mind him being aggressive if he's got the play," manager Mike Matheny said. "(Shortstop Pete) Kozma was in the right place, he just made a low throw.

    "And to do it over again, I'm sure he'd like to take the easy out at first base," he said.

    Pablo Sandoval homered for the second straight night and Zito made an extremely rare offensive contribution with a perfectly executed bunt for an RBI single.

    Giants defenders made several nice plays behind Zito, including a juggling catch in right by Hunter Pence and a spectacular sliding stop by second baseman Marco Scutaro to rob pinch hitter Shane Robinson on consecutive at-bats.

    Once again this postseason, the Giants benefited from a big error.

    Needing three straight wins at Cincinnati to avoid elimination in the division series, San Francisco began its comeback on a bobble by third baseman Scott Rolen in the 10th inning that gave the Giants the go-ahead run in Game 3.

    The Giants improved to 4-2 on the road this postseason and have won Zito's last 13 starts, with the last setback on Aug. 2. They're averaging more than six runs a game during the streak, although the lefty didn't need much help in this one.

    Lynn, an 18-game winner his first year in the rotation, failed to make it out of the fourth for the second time in the series.

    The Cardinals are seeking consecutive pennants for the first time since 1967-68, and trying to advance for the second year in a row as a wild-card entry. One more win would set up a rematch of the 2006 World Series against the Tigers, which the Cardinals took in five games.

    Lynn struck out five of the first 10 batters, sailing through the first three innings with no balls hit out of the infield. His undoing was a wild throw off the second-base bag attempting to get a forceout on a comebacker that paved the way for San Francisco's four-run fourth.

    The Giants had runners on first and second with one out when Lynn gloved a tapper by Pence, wheeled and waited a bit while Kozma hustled to second. But Lynn threw a low dart off the bag with the ball bounding into shallow right field and Marco Scutaro scoring without a play from second.

    Eighth-place hitter Brandon Crawford singled up the middle with the bases loaded on a full count with two outs as Lynn just missed with a kick save for two more runs. Zito, who has just 30 career hits in 310 at-bats in the regular season with no extra-base hits and nine RBIs, laid down a perfect bunt for a fourth run.

    Lynn has allowed four runs both of his NLCS starts, although all four were unearned in Game 5.

    Zito's only trouble came in the second when Yadier Molina and David Freese, both swinging on the first pitch, opened the inning with a single and double. Lynn, a career .056 hitter including the postseason, hit into a bases-loaded double play to end the threat.

    Lynn was 3 for 50 with 1 RBI, 10 sacrifices and 36 strikeouts during the regular season, going hitless his last 42 at-bats.

    Jets linebacker Calvin Pace recently called the Patriots? no-huddle offense ?borderline illegal.?? The Jets apparently believe that it?s the officials, not the Pats, who are failing to follow the rules.

    Defensive coordinator Mike Pettine has explained to Manish Mehta of the New York Daily News that the Jets will be emphasizing to officials the provisions that allow defenses to react and adapt to changes made in the offensive lineup.

    ?It?s going to be a major point of contention before [our] game with the officials to make sure that they know the rule is when they substitute we?re permitted to substitute,? Pettine told Mehta.

    ?If the officials permit [the Patriots] to do that, then the game is going to become chaos,? Pettine said.? ?That?s the problem.? Because we?re going to be running guys on.? We need to make sure that that is enforced for this game, because we found examples on tape where it has not been.? Then it?s impossible.? Now you can?t defend it.?

    The rulebook makes it clear that the officials have the responsibility to ensure that the defense has a fair chance to adjust to lineup changes.? Per Mehta, Rule 5, Section 2, Article 10 states that ?if a substitution is made by the offense, the offense shall not be permitted to snap the ball until the defense has been permitted to respond with its substitutions. . . . The offense is prohibited from rushing quickly to the line of scrimmage and snapping the ball in an obvious attempt to cause a defensive foul (i.e. ? too many men on the field). . . . The umpire will stand over the ball until the Referee deems that the defense has had a reasonable time to complete its substitutions.?

    ?When they change, that should trigger the ability for us to change,? Pettine said.? ?I?m all for the no-huddle and one grouping.? Whoever you put out there, you better be prepared to go through a whole series and be out there for a while.? And that?s fine.? When they change, we need to be given the right to change . . . and we?re going to make sure that right is given to us.?

    And that?s the difference between hitting the accelerator with versatile players on the field and shuttling in other players quickly in the hopes of catching the defense with its pants down.

    Should the Jets be taking their concerns public?? In a roundabout way, they are complaining about the officiating ? not from their own games, but from the games involving other teams.? The comments are, in essence, a more subtle version of Giants offensive coordinator Kevin Gilbride?s complaint that 49ers defensive end Justin Smith ?gets away with murder.?

    And now the question becomes whether Pats coach Bill Belichick will rebuke the Jets, Harbaugh-style, for both criticizing and influencing officiating.? Because, at its core, that?s precisely what the Jets are doing.

    If it works on Sunday, it will have been brilliant.

    Curiosity rover finds more shiny objects on Mars

    When NASA's Curiosity rover found a shiny object on Mars last week, researchers believed it was just part of the rover. But now, the rover has found more bright objects in Mars' soil, leading NASA officials to believe it is something native to the planet.

    NASA sent commands to Curiosity Monday to take a third sample of soil from Mars to learn more about the shiny objects.

    "Confidence for going ahead with the third scooping was based on new assessment that other bright particles in the area are native Martian material," NASA said in a statement. "One factor in that consideration is seeing some bright particles embedded in clods of Martian soil."

    The first sample taken on Oct. 7 found a shiny object that they determined was a piece of the rover. During the second scooping on Oct. 12, more bright objects were found in a hole made by the scooping, leading researchers to believe this is something native to mars.

    "At that point when they first saw the bright particles in the hole created by the second scoop they weren't sure what they were," NASA spokesman, Guy Webster, told ABCNews.com.

    Space Launch System providing engine 'brains' with an upgrade

    ScienceDaily (Oct. 18, 2012) ? America's next heavy-lift rocket needs a strong and reliable engine to launch humans beyond low Earth orbit. That's why engineers with NASA's Space Launch System program, managed at the Marshall Space Flight Center in Huntsville, Ala., will use the proven RS-25, the space shuttle's main engine during its 30-year history, to power the massive rocket's core stage. The RS-25, which was designed and developed with NASA by Pratt & Whitney Rocketdyne of Canoga Park, Calif., is a crucial part to the core stage design, but a few enhancements are planned.

    While the RS-25 engines launched 135 missions, it needs a new "brain" to drive the 3.5-ton engine.

    "The computer controlling the SSME was manufactured in the early '80s and many parts are now obsolete," said Jeremy Richard, SLS Liquid Engines Office Subsystem manager. "While working on updating the technology, we discovered we could adapt the same controller being used by the new J-2X engine to the RS-25 engine, effectively streamlining the controller and resulting in a cost savings."

    The role of an engine controller unit is to allow communication between the vehicle and the engine, sending commands down to the engine and transmitting data back to the vehicle. The controller also provides closed loop management of the engine by regulating thrust and fuel mixture ratio while monitoring the engine's health and status.

    "Our long-term objective is to use the same basic hardware design to control multiple engines," Richard said. "With a common physical design and just a few card change outs, we could control the RS-25, J-2X, and future engine designs at less than half the cost of a space shuttle main engine controller."

    Engineers with Pratt & Whitney Rocketdyne are hard at work on the J-2X engine control unit in Building 4436 at the Marshall Center. The J-2X will power the upper stage of the evolved heavy-lift rocket, capable of lifting 130 metric tons beyond low Earth orbit.

    Meanwhile, in a separate room barely 20 feet away, the same controller with a few minor alterations is undergoing rigorous testing for the RS-25. This room houses equipment to simulate the engine in flight, using real RS-25 actuators, connectors and harnesses.

    SLS engineers will spend the coming year fine-tuning the design and testing the controller unit at the Marshall Center. Once they have a proven lab-tested version, the controller will be moved to the Stennis Space Center in Mississippi for hot-fire testing in 2014.

    Building on an established infrastructure but with a modern design, the ultimate goal is a universal rocket engine controller.

    First micro-structure atlas of human brain completed

    ScienceDaily (Oct. 19, 2012) ? A European team of scientists has built the first atlas of white-matter microstructure in the human brain. The project's final results have the potential to change the face of neuroscience and medicine over the coming decade.

    The work relied on groundbreaking MRI technology and was funded by the EU's future and emerging technologies program with a grant of 2.4 million Euros. The participants of the project, called CONNECT, were drawn from leading research centers in countries across Europe including Israel, United Kingdom, Germany, France, Denmark, Switzerland and Italy.

    The project investigators met October 19 in Paris, after 3 years of research, to announce the conclusion of the project and present a report of their findings.

    The new atlas combines three-dimensional images from the MRI scans of 100 brains of volunteers. To achieve this, CONNECT developed advanced MRI methods providing unprecedented detail and accuracy.

    Professor Daniel Alexander, a CONNECT steering committee member from the UCL Department of Computer Science said: "The UCL team use the latest computer modelling algorithms and hardware to invent new imaging techniques. The techniques we devised were key to realising the new CONNECT brain atlas."

    "The imaging techniques reveal new information about brain structure that help us understand how low-level cellular architecture relate to high-level thought processes."

    Currently, biomedical research teams around the world studying brain science rely on a brain atlas produced by painstaking and destructive histological methods on the brains of a few individuals who donated their bodies to science.

    The new atlas simulates the impossible process of painstakingly examining every mm2 of brain tissue (of which there are around 100 million per brain) with a microscope, while leaving the brain in tact.

    The key novelty in the atlas is the mapping of microscopic features (such as average cell size and packing density) within the white matter, which contains the neuronal fibers that transmit information around the living brain. The results of the project, obtained through advanced image processing techniques, provide new depth and accuracy in our understanding of the human brain in health and disease.

    The atlas describes the brain's microstructure in standardized space, which enables non-expert users, such as physicians or medical researchers, to exploit the wealth of knowledge it contains. The atlas contains a variety of new images that represent different microscopic tissue characteristics, such as the fiber diameter and fiber density across the brain, all estimated using MRI. These images will serve as the reference standard of future brain studies in both medicine and basic neuroscience.

    The project will dramatically facilitate and promote future research into white matter structure and function. Historically in neuroscience, the vast majority of research effort has been invested in understanding and studying gray matter and neurons, while white matter has received relatively little attention.

    This owes largely to the lack of effective research tools to study white matter, even though it comprises about half the volume of the brain. The new MRI methods that were developed in CONNECT allow researchers, for the first time, to visualize the micro-structure of the living brain over the whole brain.

    This opens new realms in our understanding of our most complex organ. In the future, the project members intend to use the technology they have developed to study the dynamics and time dependence of the micro-structure in white matter. For example they will search for a finger print or a trace that a cognitive task imprints on white matter microstructure encoding new experiences in the wiring of the brain.

    Another future direction is to characterize and understand micro-structural changes caused by different neurodegenerative diseases, such as Alzheimer's or schizophrenia, in order to develop better diagnostic procedures for these and other devastating conditions.

    PM stands by 'lowest' tariff vow

    David Cameron: ''I want to be on the side of hard pressed, hard working families who often struggle to pay energy bills''

    David Cameron has insisted energy firms will be compelled to give customers "the lowest tariff" as he sought to clear up confusion over energy policy.

    The exact details of how this will be achieved, in next month's Energy Bill, have yet to be decided.

    But Downing Street claims consumer groups and energy firms SSE and Ovo support the policy.

    Some business groups warn it could damage competition and even lead to higher prices.

    It comes after 24 hours of apparent confusion over where the government stands, with Labour accusing ministers of throwing energy policy into "chaos".

    During Prime Minister's Questions on Wednesday, Mr Cameron made a surprise announcement promising to legislate "so that energy companies have to give the lowest tariff to their customers".

    The main energy firms said they knew nothing of the plan - or of the government's intention to put it into legislation.

    There has been a lot of uncertainty after the prime minister's statement in the Commons yesterday.

    Officials in Whitehall were saying this policy is very much in development, and the prime minister had spoken a little bit early on this.

    What we've seen today is a government that is so desperate to try and say that it is on the side of people who are feeling the pinch in a time of austerity, particularly when energy prices are rising, that they announced a policy before all their ducks were in a row.

    Energy Secretary Ed Davey appeared to distance himself from the proposal and Downing Street said energy firms would be obliged only to "offer" the cheapest tariffs.

    Energy minister John Hayes, summoned to the Commons to clear up the confusion, said a number of options were being considered.

    These included an evaluation of whether voluntary agreements made by the energy companies in April should be "made binding" through legislation.

    "This is a complicated area and we will discuss with the industry, consumer groups and the regulator in order to work through the detail," Mr Hayes said.

    But arriving for an EU summit in Brussels, Mr Cameron stood by his remarks, telling reporters: "I want to be on the side of hard-pressed hard-working families who often struggle to pay energy bills.

    "That's why I said in the House of Commons yesterday we're going to use the forthcoming legislation - the Energy Bill coming up this year - so that we ensure that customers get the lowest tariffs."

    In his statement to MPs, Mr Hayes said the government needed a "robust" relationship with the six big energy firms and would take the "necessary steps to ensure people get the best possible deal".

    Shadow energy secretary Caroline Flint said Mr Cameron had thrown energy policy into "confusion", causing "chaos" in the energy industry.

    Angela Knight, chief executive of the Energy UK - the trade association for the energy sector - told BBC News the industry had been taken by surprise by the PM's announcement and more clarity was needed on the government's position.

    She said the industry had already made progress by introducing "easily understandable tariffs, much fewer tariffs and assisting people as to how they can found out exactly which one is suitable for them".

    Business groups warned forcing companies to give customers the cheapest tariffs could damage competition in the market.

    Deputy director general of the CBI Neil Bentley said "scare stories" about the government's commitment to the energy market could "create a lot more uncertainty for companies looking to invest in the UK".

    But consumer group Which? urged Mr Cameron to "stick to the promise" he made in Parliament.

    "Just giving people information on the lowest tariff is not enough when trust is at an all-time low in the industry and switching levels are falling," Which? said.

    Greenpeace said the government's energy policy was now "as confusing as British Gas tariffs" and the UK needed to do more to reduce its reliance on gas.

    Under this voluntary arrangement the six main energy providers agreed to contact customers once a year to tell them what the best tariff is for them, and how to get it and to contact customers coming to the end of a fixed-term contract with the same advice.
